What are some laws on separation?

When people talk about separation, few realize there are two different types. Trial separation is an informal arrangement between spouses when they are considering divorce or even going through proceedings and they don’t want to live together anymore. Legal separation is much more like a divorce, with a court-approved order in place that governs critical details such as child support and visitation. Legal separation is used when a couple intends not to live together as a married couple ever in the future, but they don’t want a traditional divorce because of either tax benefits or religious beliefs.

These laws vary by jurisdiction and not all states recognize legal separation. Those that do, allow the parties to the marriage to enter into legal new york separation agreement which address issues such as property division; assignment of assets, finances and debts; child custody and child support. These agreements are recognized by a judicial body and are enforceable by law..

Look to various state laws to determine the divorce law within a particular jurisdiction. Premier Paralegal may provide further guidance.
