It's up to the place you live in. Call your lawyer or check in the net, some basic information is provided there. At least you can find a number to call for further information.

Filing for divorce is a multi-faceted process. To begin, it is wise to seek the counsel of an attorney. Second, become knowledgeable in the divorce process in your geographical context. Generally, you can file for a fault or no-fault divorce. The former can be an expedited process if several criteria are met. If you and your partner seek a no-fault divorce, you may be able to resolve a lot of the legalities before appearing before a judge. In all cases, be prepared to spend some money.

You can either file a complaint for divorce or a joint petition for divorce. The former is when you are the only one who wants the divorce while the latter is for couples who have made a mutual decision. Depending on the laws in your homeland, you will have to file to a family or divorce court, and pay a fee for the divorce processing. The steps for filing divorce can be quite confusing, so many people hire divorce lawyers to assist them, and get a higher chance for divorce approval.

Call your friend who is a lawyer first. Up to your situation he will advice you what actions to make. If you don't have any lawyer friends, search internet for information. It all depends to the local laws in your state/country.
