Although this <\/span><b>kind of legal separation <\/b><span style=\"font-weight: 400;\">does not involve a <a href=\"https:\/\/www.sciencedirect.com\/topics\/agricultural-and-biological-sciences\/marital-separation\" rel=\"nofollow\" target=\"_blank\">marital separation<\/a>, the issues that you or your spouse might want to address through it remain the same nevertheless.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">You can decide the custody of the children and visitation times, alimony issues, and child support.<\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"Legal-separation-vs-divorce\"><\/span>Legal separation vs divorce<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">As we&rsquo;ve mentioned earlier, being legally separated isn&rsquo;t the same thing as being divorced. Typically, separation, or <\/span><b>marriage separation,<\/b><span style=\"font-weight: 400;\"> appears when one or both spouses decide that they want to separate their assets and finances.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This is a very common method, as it doesn&rsquo;t require any court involvement to meet your needs. Maybe both of you want to keep the benefits of being married.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">According to <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.marriage.com\/experts\/jenni-jacobsen\" target=\"_blank\"><span data-preserver-spaces=\"true\">Jennifer Jacobsen Schulz<\/span><\/a><span data-preserver-spaces=\"true\">, LCSW:<\/span><\/p>\n<blockquote><p><span data-preserver-spaces=\"true\">A legal separation allows partners to divide assets and debts without the permanence of divorce.<\/span><\/p><\/blockquote>\n<p><span style=\"font-weight: 400;\">Legal separation vs<\/span> <a href=\"https:\/\/www.marriage.com\/advice\/divorce\/how-to-avoid-getting-a-divorce-even-after-separation\/\"><span style=\"font-weight: 400;\">divorce<\/span><\/a><span style=\"font-weight: 400;\"> is an easy choice to make when you think of tax incentives or other religious beliefs that <\/span><b>conflict with marital separation.<\/b><\/p>\n<h2><span class=\"ez-toc-section\" id=\"How-do-I-get-a-separation\"><\/span>How do I get a separation?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">In the US, some courts allow spouses to directly apply for a <a href=\"https:\/\/en.wikipedia.org\/wiki\/Legal_separation#United_States\" rel=\"nofollow\" target=\"_blank\">legal separation<\/a>, depending on the state they&rsquo;re residing in. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">It&rsquo;s important to stress out that although there is a difference between <\/span><span style=\"font-weight: 400;\">legal separation and divorce<\/span><span style=\"font-weight: 400;\">, the process of obtaining one advances pretty much the same as a divorce would.<\/span><\/p>\n<p><a href=\"https:\/\/www.marriage.com\/advice\/separation\/dos-and-donts-of-legal-separation\/\"><span style=\"font-weight: 400;\">The grounds of marriage separation<\/span><\/a><span style=\"font-weight: 400;\"> are, pretty much, the same as those of divorce.
