Agreements should be written with a few general principles in mind. Courts in most states are inclined to enforce prenuptial agreements as long as they meet three requirements:<\/span><\/p>\n<ol><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The agreement is not overly coercive;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The agreement does not violate public policy; and<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The agreement was fairly entered into.<\/span><\/li>\n<\/ol><p><span style=\"font-weight: 400;\">If a court believes any of these issues are present it may ignore the agreement completely, or it may just refuse to enforce certain clauses.<\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"What-courts-will-not-enforce\"><\/span><b>What courts will not enforce<\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">If the court believes that the agreement was entered into in a way that one of the parties was forced or compelled to sign the agreement, or if the court believes the agreement &ldquo;punishes&rdquo; one side too severely, it will refuse to enforce the agreement.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">A court will also refuse to honor any clauses that<\/span><a href=\"https:\/\/www.marriage.com\/advice\/divorce\/\"> <span style=\"font-weight: 400;\">deal with child custody or child support<\/span><\/a><span style=\"font-weight: 400;\"> as a general rule.
